General Terms and Conditions (GTC) for the sale of products and services from Relpaintstudio

Preamble

The website www.artbyrel.com is operated by Elisabeth Rode, Friedrich-Ebert-Str.17, 84489 Burghausen, relpaintstudio@artbyrel.com. These General Terms and Conditions (GTC) govern the rights and obligations of the parties in connection with the purchase of products, the use of services and digital content and the use of other services offered on the website. The products offered include art prints, original artworks, art supplies and accessories as well as digital content. You will also find a gallery and a blog on our website, the use of which is also covered by these GTC.
By accessing our website and placing an order or consuming our content, you agree to be bound by these terms and conditions. If you do not agree to any of these terms and conditions, you are prohibited from accessing the website or placing orders.


1. Scope of application

1.1 These Terms and Conditions apply to all contracts between Relpaintstudio (hereinafter “Seller”) and the customer (hereinafter “Customer”) regarding the purchase of products and services via the website www.artbyrel.com. This includes art prints, original artworks, digital content and the use of services offered on the website, in particular the blog and the gallery. 1.2 Deviating or supplementary terms and conditions of the customer are only binding if the seller has expressly agreed to them in writing.
1.3 By placing an order, the customer declares that he is of legal age in his country of residence (at least 18 years old) and accepts the GTC.
1.4 If the customer is under 18 years of age, the consent of a parent or legal guardian is required to place orders.
1.5 These GTC apply to all products and services in the version valid at the time the order is placed. It is the customer’s responsibility to regularly check the GTC for changes.
1.6 Subject matter of the contract: The seller offers products for sale that are described and illustrated on the website. This includes physical works of art, prints and original paintings.
1.7 The use of the website and the services offered is only permitted for lawful purposes. It is prohibited to use the website for illegal or unauthorized purposes, in particular not to infringe applicable copyright law or the rights of third parties.


2. Conclusion of contract

2.1 The presentation of the products on our website does not constitute a binding offer for sale, but a non-binding invitation to the customer to submit an offer. The product presentation may include various categories, including original images and reproductions (prints).
2.2 By submitting the order via the website, the customer submits a binding offer that can be accepted in accordance with the provisions of these GTC. The seller confirms receipt of the order by e-mail and accepts the order by dispatching the goods or by sending an express confirmation e-mail.
2.3 A purchase contract is only concluded when the seller accepts the customer’s order by dispatching the goods or by expressly confirming the offer. Until then, the customer’s order remains a non-binding offer.
2.4 If a product is no longer available after the order has been placed (e.g. in the case of works of art that only exist once), the seller will notify the customer immediately and refund any amounts already paid.
2.5 The Seller reserves the right to refuse orders without giving reasons. This may be the case, for example, if the order violates applicable law or these GTC or if there are technical problems in processing the order.
2.6 In the case of orders for products that are individually manufactured or made to special customer requirements (e.g. customized works of art), the customer is expressly informed that there is no right of withdrawal for these products.

3. Prices and terms of payment

3.1 All prices on the website are quoted in euros (€) and, as a small business within the meaning of § 19 UStG, no VAT is shown. However, the prices do not include shipping costs, which are incurred in addition to the purchase price and are shown separately in the order process.
3.2 The shipping costs depend on the respective product, the order value and the customer’s delivery address. The exact shipping costs will be calculated during the ordering process and displayed to the customer before he completes the order.
3.3 Payments must be made in the form specified in the order process. Accepted payment methods include:

  • PayPal
  • Credit card / debit card (Visa, MasterCard, American Express…)
  • Applepay
  • Googlepay

The Seller reserves the right to change or extend payment methods at any time.
3.4 The seller reserves the right to delay delivery of the goods until full payment has been received. If payment is delayed, the seller also reserves the right to cancel the order.
3.5 In the event of late payment, the seller is entitled to charge interest on arrears at a rate of 5 percentage points above the prime rate. This applies to consumers and companies.
3.6 Further costs arising from the payment methods (e.g. currency conversion fees or international bank charges) shall be borne by the customer.


4. Delivery and shipment

4.1 Delivery shall only be made after full payment has been received.
4.2 Delivery shall be made to the address specified by the customer. The customer is obliged to provide the correct and complete address.
4.3 The estimated delivery time is stated in the order process and depends on the product and delivery location. The seller shall endeavor to ship the goods within the specified delivery times.
4.4 Upon receipt of the goods, the customer is obliged to check them for completeness and any damage and to report any defects to the seller immediately.
4.5 If delivery is not possible due to an incomplete or incorrect address of the customer, the customer shall bear the new shipping costs.
4.6 Transfer of risk: For consumers, the risk of accidental loss and accidental deterioration of the goods shall not pass until the goods are handed over to the customer. For entrepreneurs, the risk is already transferred to the customer when the goods are handed over to the shipping service provider.


5. Right of withdrawal and return

5.1 Right of withdrawal for the customer: Customers have the right to cancel the contract within 14 days of receipt of the goods without giving any reason.
5.2 Exceptions to the right of withdrawal: The right of withdrawal does not apply to products that are made at the customer’s request or according to customer specifications, such as personalized works of art or individual services.
5.3 Exercising the right of withdrawal: To exercise the right of withdrawal, the customer must inform the seller of his decision to withdraw from the contract within 14 days of receipt of the goods by means of a clear declaration (e.g. by e-mail or letter).
5.4 The goods will be returned at the customer’s expense, unless the delivered goods do not correspond to the order or are defective. Please check the packaging of your shipment carefully for external damage upon receipt. If the packaging is damaged, please take photos of the packaging before opening it. Without this proof, I am unfortunately unable to process a complaint, refund or replacement delivery.
5.5 Refund: The seller will refund the purchase price to the customer within 14 days of receipt of the return. The purchase price will be refunded to the original means of payment, unless the customer has expressly agreed otherwise.
5.6 Conditions for returns: The goods must be returned unused, in perfect condition and in the original packaging in order to receive a full refund of the purchase price.

6. Warranty and liability

6.1 Warranty claims: The seller shall be liable in accordance with the statutory provisions for defects in the goods existing at the time of delivery. The statutory warranty periods of two years from delivery shall apply.
6.2 Limitation of liability: The seller is not liable for damage caused by improper use, improper storage or improper care of the products.
6.3 Liability for transport damage: Transport damage must be reported immediately to the shipping service provider. Liability for damage during transportation lies with the shipping service provider, unless the customer has taken out transport insurance.


7. Data protection

7.1 The Seller processes the Customer’s personal data in accordance with the Privacy Policy. The privacy policy can be viewed on the website.
7.2 The data is used to process orders, for customer support and to provide contractual services. Data will only be passed on to third parties if this is necessary to fulfill the contract (e.g. shipping service providers, payment providers).
7.3 The customer has the right to receive information about their stored personal data at any time and to have it corrected or deleted.


8. Use of the blog and the gallery

8.1 The content of the blog and the gallery may only be consumed for private purposes and within the scope of the services offered.
8.2 Any commercial use of the content provided on the website, in particular by reproduction, publication or redistribution, is prohibited without the express written permission of the seller.
8.3 All works of art and content published on the website are protected by copyright. Any reproduction, distribution or modification of the content without the express consent of the copyright holder is prohibited.


9. Products or services

9.1 We have made every effort to display the colors and images of our products that appear in the store as accurately as possible. We cannot guarantee that your computer screen will display every color correctly.
9.2 We reserve the right, but are not obliged, to restrict the sale of our products or services to certain persons, geographical areas or jurisdictions. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of products or services we offer. All product descriptions or product prices are subject to change at any time without notice and at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.


10. Errors, inaccuracies and omissions

10.1 Occasionally there may be typographical errors, inaccuracies or omissions in product descriptions, pricing, promotions, offers, product shipping charges, delivery times and availability on our site or in the Service. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information on the Service or on any related website is incorrect at any time without prior notice (including after you have submitted your order).


11. Severability clause

11.1 If any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, that provision shall nonetheless be enforceable to the fullest extent permitted by law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any remaining provisions.


12. Final provisions

12.1 The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
12.2 The place of jurisdiction is the registered office of the seller, provided that the customer is a merchant or a legal entity under public law.
12.3 Should any provision of these GTC be or become invalid, this shall not affect the validity of the remaining provisions.
12.4 The Seller reserves the right to amend these GTC at any time. The customer will be notified of any changes in good time.
